In using the above services mentioned or any other additional services associated with, you will

• Comply with all usage terms and conditions
• Comply with all payment terms and conditions.
• Obey the service usage policies.
• Comply with terms and conditions applicable from Third party service vendors for their services through HCPIIS.
• Obey any codes of conduct or other notices we provide;
• Obey the HCPIIS Security Policies.
• Keep your service account password secret; and
• Promptly notify us if you learn of a security breach related to the service.

 HCPIIS has the right’s to deny any services if you are violating the terms of use in a manner as mentioned below.

• Use of the service in a way that harms us or our affiliates, resellers, distributors, and/or vendors or any customer HCPIIS
• Any portion of the service used as a destination linked from any unsolicited bulk messages or unsolicited commercial messages (“spam”).
• Unauthorized third party software or service to access the HCPIIS messaging network.
• Any use of automated process or service to access and/or use the service (such as a BOT, Brute force attack that causes damage, disable, overburden, or impair the service to HCPIIS network.
• Using any unauthorized means to modify or reroute, or attempt to modify or reroute, the service.
• Resell or redistribute the service, or any part of the service unless agreed by HCPIIS.

 Only you may use your service account. For some parts of the service, we may notify you that you may set up additional member accounts that are dependent on your account (an “associated account”). You are responsible for all activity that takes place with your service account or an associated account. You may not authorize any third party to access and/or use the service on your behalf.

Web Applications and Service Management

Web Hosting.

 We use the information that you provide for such purposes as responding to your requests, providing our services (e.g., domain name registration, DNS hosting), and communicating with you.
 This Web website gives you the ability to learn about HCPIIS and its products and services as well as the ability to access our network and services ("HCPIIS Services"). By using this website, and any other sites or services owned, operated, or provided by HCPIIS, you signify your agreement to the terms, conditions and notices of this policy. "You" when used in the Agreement shall mean the HCPIIS Customer of record and that HCPIIS Customer's end users.

Website Design

 HCPIIS creates and publishes websites for its customer on the basis of written agreement accepted by the customereither online or offline. HCPIIS designs new websites and register new domains based on customer requirement.
 HCPIIS content management system do not generate any content or data related to its customer’s website and HCPIIS is not responsible for any such data that reflects the content from another website.
 HCPIIS design team constantly monitors customer data and any such data found violating HCPIIS website design policy will be subjected to extreme action against the customer.

Source Code Rights

• You may not copy and distribute the design code form of the Website in programs developed by HCPIIS.
• You may not combine the source code of the website with your programs to develop a unified web solution and permit others via online methods to access and use that unified web solution.
• You may not permit customers of your Website to copy and distribute the Source Code as part of your online programs.
• Require your end users to agree to terms that protect it at least as much as this agreement;
• Display your valid copyright notice on your Website.
• Alter any copyright, trademark or patent notice in your website and notify to your customers.
• You must use HCPIIS Webmasters Design logo at the bottom of your webpage
• You may not include malicious, deceptive or unlawful programs in your Website.
DOCUMENTATION.
• Any person with valid access to your computer/devices or internal network may copy and use the documentation for your internal, reference purposes.

Corporate Email Service

 If you purchase a third party product or service from the Company, you agree to this Agreements AND the following terms and conditions of the third party product or service, which are incorporated herein and made a part of this Agreement by reference:

 We offer Google Workspace product at a similar price. However, the additional advantage with HCPIIS is the ease of managing everything by our backend team helping you in concentrating with your business rather than configuring and monitoring your email and other services offered by Google Workspace.

Domain Name Registration. If you choose to associate the Google Workspace email service with a domain name, you must maintain your domain name registration with us in order to send and receive email messages. If the associated domain name expires, HCPIIS reserves the right to suspend the associated email services until such time that the associated domain name is renewed.

Additional Terms for Legacy free edition of G Suite

• Google Workspace Legacy ( G-Suite Legacy ) limitations

 The Service is provided at no charge to Customer provided that Customer agrees that Google may Offer additional optional services to Customer or its End Users for a fee or offer a premium version of the Service for a fee.
  Google may, at any time, discontinue the free version of the Service and only offer a premium version.
In this event, Google will provide notice consistent with this Agreement and Customer will have the opportunity to convert to the premium version.

• HCPIIS Liabilities

HCPIIS hereby holds no responsibilities for service termination of Legacy free edition of Google Workspace(G Suite) editions from Google Inc.

• Primary Domain Changes

Deletion or removal of primary domain from Legacy free edition of Google Workspace(G Suite) edition may directly inflict damage to secondary domains.In such case HCPIIS holds all rights to terminate the Legacy free edition of Google Workspace(G Suite) edition account under primary domain or make default domain as primary domain.

• Primary Domain change damages

Deletion of primary domain may result in termination of Legacy free edition of Google Workspace(G Suite) edition and all associated secondary domains.In such case owner of primary domain is liable to compensate secondary domains with Paid version of Google Workspace account with Business Starter plan. This includes total number of user-id's in each secondary domains.

• Compensation for Secondary Domains

Primary domain owner is liable for all fees and payments for secondary domains listed in Legacy free edition of Google Workspace(G Suite) edition till the termination of secondary domains by their respective owners.

• DNS, SRV, SPF, DKIM, MX Records

You acknowledge and agree that we will automatically add a SRV, SPF, DKIM, MX records to your DNS if your domain name is registered with HCPIIS. The SRV, SPF, DKIM, MX and other DNS records may be removed when the last email address associated with the domain name is removed or when the domain name is transferred.

• Trial Account.

From time to time, at our discretion, we may offer free trials of Online Storage (“Trial Account”) for the purpose of allowing you to sample the Service before committing to paying a fee. You agree that you are limited to one (1) thirty (30)-day trial account. Upon its expiration, you will not have access to your Trial Account. To continue using Online Storage, you must convert to a paid account before your Trial Account expires or within fourteen (14) days after expiration, after which time we reserve the right to delete your Trial Account and any customer data associated with such account without notice. We expressly disclaim any liability or responsibility for any loss or damage arising from or related to our deletion of your account information and customer data. We reserve the right to discontinue Trial Accounts at any time and without notice.

• Plan Limits

You acknowledge and agree that Email is offered with different plan levels or limits. These plan limits are presented either on the Email landing page or on this website and may relate to (i) the number of recipients allowed per email message, (ii) the number of email messages allowed per day, (iii) the size of each email message and/or attachment, (iv) the number of contacts allowed per shared address list, (v) the number of contacts allowed per distribution list, (vi) the number of email messages allowed per minute, (vii) the number of devices allowed per account, or (viii) such other items as we may specify.

E-Mail Usage Resource Limits

 You agree not exceed the mail usage limits as per your data package plan. Any mail usage exceeding the limits or approaching limits are subject to policy enforcement.
 Mailing lists, email newsletters, single emails, and other types of messages are all counted in the global quota. These scripts MUST be setup to throttle amount of emails sent in a defined period, and MUST be significantly below the above limits. The nature of emails sent must also comply with all guidelines and requirements outlined on our policies. Your account may be suspended, or terminated, at our discretion without prior notice if any of these policies are violated. These limits are in place to allow for fair usage for all our customers on our servers, therefore it is in your best interests as a customer to rigorously adhere to these policies. If you require higher email usage we strongly recommend looking into one of our dedicated server plans. Contact our sales department for more information regarding options.
 This policy is subject to change without notice and may be adjusted at any time or under any circumstances at our discretion, to ensure continued reliability and performance of all our services.

System and Network Security.

 Violations of system or network security are strictly prohibited, and may result in criminal and civil liability as well as termination of services from HCPIIS. HCPIIS investigates all incidents involving such violations and will cooperate with law enforcement if a violation of the criminal law is suspected.
 You are responsible for any misuse of your account, even if a friend, family member, >guest, agent, or employee committed the inappropriate activity while using your account. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach the security of another HCPIIS account or attempt to gain unauthorized access to another network or server.

Service Transfer to Third Party.

 The first user of the Website may transfer website and this agreement directly to a third party. Before the transfer, that party must agree that this agreement applies to the transfer and use of the Website. The first user must notify HCPIIS before transferring. The first user may not retain any copies. In addition to this general terms and conditions of use you must comply with HCPIIS Website Design Policy for website Design, Hosting and Publishing.

Service Denial by HCPIIS

• Introduction into the network or server of any malicious program (examples: viruses, worms, Trojan Horses, logic bombs, and other executable’s intended to inflict harm).
• Introduction into the network or server of any self-extracting file or program containing any malicious program.
• Introduction into the network or server of any data, parameter, configuration, template, or control files for software applications that contain destructive macros or other malicious code.
• Introduction into the network or server of any encrypted or compressed file or archives that contains any malicious program.
• Affecting security breaches or disruptions of Internet communication and/or connectivity. Security breaches include, but are not limited to, accessing data of which the Customer is not an intended recipient, logging into a server or account that the Customer is not expressly authorized to access, or exceeding the access to a server or account that has been granted to the Customer. For purposes of this section, "disruption" includes, but is not limited to port scans, flood pings, email-bombing, packet spoofing, IP spoofing, and forged routing information.
• Executing any form of network activity that will intercept data not intended for the Customer.
• Circumventing user authentication or security of any host, network or account.
• Interfering with or denying service to any user other than users of the Customer's host (examples: denial of service attack or distributed denial of service attack).
• Using any program script/command, or sending messages of any kind such as a punter, designed to interfere with or to disable, a user's terminal session, via any means, locally or via the Internet.
• Attempting to use or gain unauthorized access to data, accounts, hosts, servers, systems or networks of this website, or to probe, scan or test the vulnerability of a system or network of this website, any HCPIIS Services or those of any other party.
• Interfering with service to any user, host or network including, without limitation, mail-bombing, flooding, or attempting to overload the system.
• Forging any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting.

Anti-Spam Policy

Unsolicited commercial e-mail and electronic messages are colloquially referred to as "spam." Other common names for spam include "spam e-mail," "junk e-mail," "bulk e-mail," "direct e-mail," and "mass e-mail." Spam is the electronic equivalent of the direct mail you receive in your postal mailbox frequently. In its most general terms, and as used in this Anti-Spam Policy SPAM is a commercial e-mail message or other electronic message, including, but not limited to, messages that are:

• Posted to an electronic mailing list (other than an "opt-in" e-mail list as described below),
• Posted on an online bulletin board system or Web-based message board system or "guest book",
• Posted to a Usenet newsgroup.
• Posted to the common area of an online community, group, or club.
• Posted in a chat room.
• Posted in a message board of a commercial online service.
• Posted to a Weblog.
• Sent via an instant message system.
• Sent through e-mail or another Internet means of communication when the message's ultimate destination is a facsimile ("fax") machine, cellular or wireless telephone, or wireless device,
• A commercial e-mail message or other electronic message that is addressed to one or more recipients with whom you do not have an preexisting business or personal relationship,
• A commercial e-mail message or other electronic message that is sent to a mailing list of addresses that you purchased or that were otherwise distributed, or any list of e-mail addresses whose owners did not sign up for your specific mailing list, including without limitation lists commonly known as "affiliate lists,"
• A commercial e-mail message or other electronic message that is not sent at the request of, or with the express consent of, the recipient(s),
• A commercial e-mail message or other electronic message that is sent to a recipient who has opted out of receiving further commercial electronic messages from you, or
• A commercial e-mail message or other electronic message that contains forged headers, compromised mail server relays, or false contact information.

Zero Tolerance for Spam.

HCPIIS will not tolerate any spamming by any of its Customers. This prohibition of spam extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of HCPIIS services whether or not the message actually originated from our network. Violation of this Anti-Spam policy will result in HCPIIS taking one or more of the following actions:

• A warning via e-mail or telephone,
• Suspension of your website until further notice,
• Removal of DNS for the advertised/originating website, or
• Temporarily blocking outgoing mail from your website.

Repeated violation of this Anti-Spam policy will result in immediate disconnection of service with no re-activation. HCPIIS reserves the right to take all legal and technical steps available to prevent unsolicited bulk e-mail or other unauthorized e-mail from being sent from or transmitted through the HCPIIS Network.

PLEASE NOTE: The transmission of spam, including the transmission of counterfeit e-mail, may result in civil and criminal penalties against the sender, under various federal, state, and local laws and regulations.

General Prohibitions.

• You may not use this website or HCPIIS Services for any purpose that is unlawful or in any manner that could damage,disable, overburden or impair the operation of this website, the HCPIIS Network, or HCPIIS Services, or any other party's use or enjoyment of this website, the HCPIIS Network, or HCPIIS Services.
• Adult Content Prohibited on All HCPIIS Servers

 You may not use HCPIIS services for adult-oriented and pornography sites. This includes sites that may include sexual content, or links to adult content elsewhere. In some jurisdictions, even the notice and advertisement of adult-oriented services may be illegal. It is your sole responsibility to learn the laws that govern them. As part of your agreement with HCPIIS, you must comply with all such applicable laws. However, HCPIIS cannot and does not advise you or make any recommendations to you about the existence of any such laws in a particular jurisdiction. Nor does HCPIIS advise you about how to comply with any such laws. Furthermore, laws vary throughout India and all over the world, so you should contact your legal advisor for more information and specific recommendations concerning the kinds of online materials that are legal in your region. If you use HCPIIS service to publish any content that any applicable law deems "harmful," "inappropriate," or "unsuitable" for minors (persons under 18 years of age), then HCPIIS reserves right to deny further services with or without prior notification, since it is a major breach of this agreement. You may not use HCPIIS services to sell or solicit sales for any of the following items, products or services because they are or may be illegal in one or more jurisdictions where HCPIIS services are offered, or where they can be viewed through HCPIIS services: Online pornography or adult content for which a viewer must subscribe to access it, Adult content-related products or services (including X-rated videos, pictures, etc. especially of individuals under 18 years of age), and Obscene materials, as defined by law. If we find content in any of our services managed by you (or any of the sites of your customers ) to be selling any of the prohibited products or services, the offending accounts shall be subject to immediate account termination.

Electronic Communication

 When you visit HCPIIS websites or send e-mails to us or give us your feedback, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on HCPIIS website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Your Account

 If you are the user of an associated account, then the holder of the service account has full control over your associated account. This control includes the right to end the service, close or alter your associated account at any time, and, in some cases, to request and receive machine and service use information related to your associated account.

 If you use HCPIIS, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and also you agree to accept responsibility for all activities that occur under your account or password. HCPIIS does sell products for children, but it sells them to adults, who can purchase with a credit card or otherwise. If you are under 18, you may use HCPIIS only with involvement of a parent or guardian or otherwise, HCPIIS has the right to cancel any order or service to the User. HCPIIS and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

HCPIIS is associated with various business partners for the supply and service of goods directly to the customers. HCPIIS is a marketplace for the products with its business partners. The after sales service and warranty for the products sold by our business partners, as duly applicable, for the respective products, will be taken undertaken and handled by the respective business partners or through their respective service centers.

Payment Terms and Conditions

Payment

 When you create a billing account, you enter your payment method. You must be authorized to use the payment method. You authorize us to charge you for the service using your payment method and for any paid feature of the service for which you choose to sign-up or use while this contract is in force. You will pay service charges in advance. We may charge you a different amount than what you approved. If it is a greater amount, we will tell you the amount and the date of the charge at least 10 days before we make the charge. Also, we may charge you up to the amount you have approved, and notify you in advance of the difference. We may bill you for more than one of your prior billing periods together. If we informed you that the service will be provided indefinitely or automatically renewed, we may automatically renew your service and charge you for any renewal term.
*Updates to Your Billing Account. You must keep all information in your billing account current, including your billing address and the expiration date of your Credit Card/Debit Card. You may change your payment method at any time. If you tell us to stop using your payment method, we may cancel your service. Your notice to us will not affect charges we submit to your billing account before we reasonably could act on your request.

Free Service Offers.

 You may have received a limited time of free service from HCPIIS or from a Third Party Service provider. Unless we notify you otherwise, if you are participating in any free service offers, you must cancel the service by the end of the free service period to avoid incurring charges. If you do not cancel your service, and we have informed you that the service will automatically be converted into a paid subscription at the end of the free service period, then you authorize us to charge you for the service.

Trial Period Offers.

 You may have received a limited time of free service or some other trial period offer. Unless we notify you otherwise, if you are participating in any trial period offer, you must cancel the service by the end of the trial period to avoid incurring charges. If you do not cancel your service, and we have informed you that the service will automatically be converted into a paid subscription at the end of the trial period, then you authorize us to charge you for the service.

Prices and Price Increases

 The price for the service excludes all taxes and phone charges, unless stated otherwise. These taxes and charges are your responsibility. Currency exchange settlements are based on your agreement with your payment method provider. We may change the price of the service from time to time, but we will tell you before we do.If there is a specific time length and price for your service offer, then that price will remain in force for that time. After the offer period ends, your use of the service will be charged at the new price. If your service is on a period basis (for example, monthly), with no specific time length, then we will tell you the date of any price change. That date will be not less than 30 days after we tell you of the price change. If you do not agree to these changes, then you must cancel and stop using the service before the changes take place. If you cancel your service, then your service ends at the end of your current service time length or, if we bill your account on a period basis, at the end of the period in which you cancelled.

Refund Policies.

 Unless otherwise provided by law, all charges are non-refundable unless stated otherwise and the costs of any returns will be at your expense. We will provide you with an online billing statement. This is the only billing statement that we provide. If you request a paper copy, we may charge you a retrieval fee. We will only provide paper copies for the past 30 days. If we make an error on your bill, we will correct it promptly after you tell us and we investigate the charge. You must tell us within 30 days after an error first appears on your bill. You release us from all liability and claims of loss resulting from any error that you do not report to us within 30 days after the error first appears on your online statement. If you do not tell us within this time, we will not be required to correct the error.

Canceling the service.

 You may cancel the service at any time, with or without cause. Certain service offers may require cancellation charges, and you will pay all cancellation charges as specified in the materials describing the offer. Cancellation of the service by you will not alter your obligation to pay all charges made to your billing account.

Late Payments.

 Except to the extent prohibited by law, we may assess a late charge if you do not pay on time. You must pay these late charges when we bill you for them. We may use a third party to collect past due amounts. You must pay for all reasonable costs we incur to collect any past due amounts. These costs may include reasonable attorneys’ fees and other legal fees and costs. We may suspend or cancel your service if you fail to pay in full on time.

Internet Access service.

 If the service does not include Internet access, then you are responsible for paying the fees charged by your Internet access provider. Those fees are in addition to the fees you pay us for the service. The rest of this section applies only if your service includes Internet access.If you use a dial-up modem, you are responsible for determining if the numbers you select will incur toll charges. To do this you must contact your telephone company first. Tell them the numbers you consider using. Your telephone company can tell you if using those numbers will trigger additional charges. Ask them if there are other telephone service charges you will incur using those numbers. You should contact your phone company even if we provided the number as an appropriate access number for you. We rely on others to provide us with that information. Unfortunately, sometimes it is wrong. If you incur any extra charges, then you must pay them. We will not reimburse you for them. You also will pay any additional charges you incur if you connect to the service through a service telephone number while you are in a country that is not the country associated with your service account (“roaming charges”). Roaming charges are in addition to any long distance telephone charges you may incur when connecting to the service from another country. Please check the service information area to view the current rates for roaming charges. You may also incur additional charges if your usage of the service exceeds the number of hours covered by your service plan.

Payments to You.

 Your right to any payment due you under a service is conditioned upon you promptly providing us with all information we require to properly make the payment (for example, bank account information for receiving the payment). We will use reasonable efforts to tell you what information we require in advance of your use of the applicable service. Even if we do not tell you in advance, you must provide us the information we request before your right to receive the payment accrues. You are responsible for the accuracy of the information you provide and any taxes you may incur as a result of receiving a payment. You must also comply with any other conditions we place on your right to any payment. If you receive a payment that was not due to you, we may reverse or seek return of the payment and you agree to cooperate with us in our efforts.

Assignment of Rights.

 You will not sublicense, lease, rent, or lend your rights in the Software, Documentation, or license keys, as granted by this Agreement, to any party without prior written consent of HCPIIS.

Product Specific Special Terms.

 The provisions of this Section are applicable to the specific product mentioned and are exceptions to other provisions of this Agreement, and serve to modify such provisions only to the extent such provisions relate to these products.

HCPIIS Server - Notwithstanding anything to the contrary set forth in this Agreement, you are permitted to duplicate and distribute the HCPIIS products, on a standalone basis or combined with other products provided,

• You do not make any modifications to HCPIIS products and distribute the entire HCPIIS products.
• You do not modify or remove any proprietary rights notices or markings, or remove or modify this Agreement as included in any such distribution.
• you clearly indicate that HCPIIS product is included in your distribution.
• You third party software in any way that might state or imply HCPIIS's or a third party's endorsement of your product, and you do not transfer with any such copy any license keys for HCPIIS products.
• HCPIIS products distributed without a license key will operate with only reduced functionality and if a license key for HCPIIS products expires and is not renewed, it will continue to operate with only reduced functionality. This reduced functionality version is licensed on a perpetual basis, without charge, subject to compliance with the terms of this Agreement.

Proprietary Rights to Software and Trademarks.

 You acknowledge that the Software and the Documentation are proprietary to HCPIIS, and the Software and Documentation are protected under Indian copyright law and international treaties. You further acknowledge and agree that, as between you and HCPIIS, HCPIIS owns and shall continue to own all right, title, and interest in and to the Software and Documentation, including associated intellectual property rights under copyright, trade secret, patent, or trademark laws. This Agreement does not grant you any ownership interest in or to the Software or the Documentation, but only a limited right of use that is revocable in accordance with the terms of this Agreement. Any and all trademarks or service marks that HCPIIS uses in connection with the Software or with services rendered by HCPIIS are marks owned by HCPIIS. This Agreement does not grant you any right, license, or interest in such marks, and you shall not assert any right, license, or interest in such marks or any words or designs that are confusingly similar to such marks.

Confidentiality.

 You shall permit only authorized users, who possess rightfully obtained license keys, to use the Software or to view the Documentation. Except as expressly authorized by this Agreement, you shall not make available the Software, Documentation, or any license key to any third party. You will use your best efforts to cooperate with and assist HCPIIS in identifying and preventing any unauthorized use, copying, or disclosure of the Software, Documentation, or any portion thereof.

Intellectual Property Protection and Confidentiality

 THE SOFTWARE IS COPYRIGHTED AND IT IS LICENSED TO YOU UNDER THIS AGREEMENT AND IS NOT SOLD TO YOU. BY DOWNLOADING, INSTALLING OR USING THE SOFTWARE OR OBTAINING A LICENSE KEY TO THE SOFTWARE, OR BY ENTERING INTO AN ORDER WHICH REFERENCES AND PROVIDES SOURCE INFORMATION NECESSARY FOR ACCESSING AND REVIEWING THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, THAT YOU UNDERSTAND IT, AND THAT YOU ACCEPT AND AGREE TO BE BOUND BY ITS TERMS. IF YOU ARE NOT WILLING TO BE BOUND BY THE TERMS OF THIS AGREEMENT, YOU SHOULD TERMINATE THE DOWNLOAD OR INSTALLATION PROCESS, AND REFRAIN FROM ACCESSING OR USING THE SOFTWARE. THIS AGREEMENT, INCLUDING ANY ORDERS, REPRESENTS THE ENTIRE AGREEMENT BETWEEN YOU AND HCPIIS CONCERNING THE SOFTWARE, AND THIS AGREEMENT SUPERSEDES AND REPLACES ANY PRIOR PROPOSAL, REPRESENTATION, OR UNDERSTANDING YOU MAY HAVE HAD WITH HCPIIS RELATING TO THE SOFTWARE UNLESS YOU HAVE ENTERED INTO A SEPARATE WRITTEN AGREEMENT SIGNED BY HCPIIS THAT EXPRESSLY AMENDS THIS AGREEMENT.

Trademark

 The logo / image of HCPIIS on the home page of the websites & other pages and as used in the communication to the User is registered by HCPIIS and cannot be used or communicated or distributed without the specific and written permission of HCPIIS.

License and Website Access

 You may not use any HCPIIS logo or other proprietary graphic or trademark as part of the link without express written permission. website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of these websites or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. These sites/applications or any portion of these sites/applications may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited.

Disclaimer of warranties and limitations of liability

HCPIIS has made this service available to use as a matter of convenience. HCPIIS expressly disclaims any claim or liability arising out of uploading of any obscene, vulgar or pornographic images, photograph or a picture or altering or distorting the images available under this service in an obscene, vulgar or pornographic manner. HCPIIS also disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. HCPIIS does not warrant that these sites/applications, its servers, or e-mail sent from HCPIIS are free of viruses or other harmful components. HCPIIS will not be liable for any damages of any kind arising from the use of these sites/applications, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. The Service(s) of HCPIIS is provided on an "as is" basis without warranties of any kind, whether express or implied. HCPIIS does not represent or warrant maintaining the confidentiality of information; although HCPIIS's current practice is to ensure reasonable efforts to maintain such confidentiality. It is also clearly understood by the User that all warranties and after sales services, implied or expressed, take place directly between the vendors and the User/buyer/customer and the terms of sale by the vendor HCPIIS will not be responsible for any damage suffered by Users from use of the services on its sites/applications. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer or mobiles virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

HCPIIS assumes no liability whatsoever for any monetary or other damage suffered by you on account of:

• The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the services.
• Any interruption or errors in the operation of the services. You expressly understand and agree that HCPIIS shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if HCPIIS has been advised of the possibility of such damages.
• User agrees and acknowledges that User shall be solely responsible for User's conduct and that HCPIIS reserves the right to terminate your rights to use the service immediately, notwithstanding penal provisions under the Indian cyber laws or any other allied laws enacted by the Government of India or any other statutory, legislative or regulatory authority authorized in this regard from time to time. In no event shall HCPIIS, its affiliates, employees, agents, consultants, contracted companies be liable for any direct, indirect, punitive, incidental, special or consequential damages or for any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the HCPIIS sites/services/applications for interrupted communications, delay, lost data or lost profits arising out of or in connection with this agreement.
• HCPIIS therefore neither endorses nor offers any judgment or warranty and accepts no responsibility or liability for the authenticity/availability of any of the goods/services/or for any damage, loss or harm, direct or consequential or any violation of local or international laws that may be incurred by your visit and/or transaction/s on HCPIIS.
• HCPIIS shall not be liable for any delay / non-delivery of purchased goods by the vendors, trade organization/s, manufacturers / shop etc. (vendors), due to flood, fire, wars, acts of God or any cause that is beyond the control of HCPIIS.
• All prices, unless indicated otherwise are in Indian Rupees and HCPIIS reserves the right to enhance the currency offerings or limit the currency offerings at any time without notice.
• The availability of products is subject to change without prior notice at the sole discretion of HCPIIS and orders can be cancelled if the product goes out of stock with the Vendor/Seller.
• HCPIIS reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price which may be higher or lower than published. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card or cheque or otherwise. In the event the payment has been processed by HCPIIS the refund amount shall be credited to the respective account or sent by different payment modes, and you would be duly notified by email.
• In a credit/debit card transaction, you must use a credit /debit card that is issued in the name of the User. HCPIIS will not be liable for any credit/debit card fraud because of the card being used fraudulently. The liability to use a credit/debit card or a net banking transaction fraudulently will be on the User and the onus to 'prove otherwise' shall be exclusively on the User.
• Any request for cancellation of orders once duly placed on the website, shall not be entertained. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost incurred by HCPIIS for re-delivery shall be claimed from the User placing the order.
• HCPIIS and its affiliates reserve the right to cancel orders for the product in their sole discretion for any reason which can include but not limited to, the product being out of stock, or for any other reason without intimation to the User.
• Business entity registration:If you are registering as a business entity, you represent that you are duly authorized by the business entity to accept these Terms & Conditions/User Agreement and you have the authority to bind that business entity to these Terms & Conditions/User Agreement.

Risk of Loss

All items purchased from HCPIIS are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon the delivery to the carrier by the vendor/merchant/affiliate/manufacturer.

Applicable law

 This website is created and controlled by HCPIIS. HCPIIS reserves the right to make changes to the terms, conditions and disclaimers at any time and without prior notification to the customers/users of the services provided by HCPIIS. However HCPIIS does notify via links to updated terms over Invoice's, Quotation's/ Email Notification's and through HCPIIS Website. Users are advised to regularly check for any amendments or updates to the terms and conditions contained herein.

Termination due to Non-Compliance with Agreement

 Notwithstanding other legal remedies that may be available to HCPIIS, HCPIIS may in its sole discretion limit user activity by immediately removing user listing either temporarily or indefinitely or suspend or terminate user membership, and/or refuse to provide user with access to the sites/applications if:

• The user is in breach any of the terms and conditions of this agreement and/or the terms and conditions of usage of HCPIIS.
• The user has provided wrong, inaccurate, incomplete or incorrect information during registration of services from HCPIIS or any other Third Party Sevice Provider.
• The user attempts to defraud HCPIIS by using the functionalities on the websites/ mobile sites/applications.
• Your actions may cause any harm, damage or loss to the other Users in HCPIIS Network or HCPIIS Directly or Indirectly.
• Illegal and/or unauthorized use of the service, including unauthorized framing of or linking to HCPIIS will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.

Entire Agreement

 These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. The clauses as above shall survive the termination or expiry of this agreement. This is an electronic record of agreement and does not require any physical or digital signatures and is valid only if visited or printed from HCPIIS official website https://hcpiis.com.
Note: The most current version of our Agreements on our website supersedes any previous agreements, arrangements or terms noted at any other time in the past or present.
